Company shall mean Sellmyhouse Ltd, Company Registration No 6414352, of registered address, Office F5 Redwither Business Centre, Abbey Road, Wrexham, LL13 9XR.
Buyer shall mean any User who is using the Website for the purposes of buying a property.
Local Property Specialists shall mean companies or individuals advertising their goods or services on the Website.
Listing Fee the amount due from the Seller to the Company on completion of a listing.
Seller shall mean any User who is using the Website for the purpose of sellin a property.
User shall mean any person using the Website for any purpose.
Unique Discount Code shall mean the code received during registration which may be used to obtain discounts from the Local Property Specialists.
Website shall man sellmyhousewrexham.co.uk, owned by Sellmyhouse Ltd.
By using the Website the User agrees to these Terms and Conditions.
In no event or circumstance shall the Company be liable for any special, indirect or consequential damages, or damages whatsoever resulting from loss of use, data or profits, whether in an action of contract or negligence, arising out of or in connection with the use or performance of information contained in the Website,
It is the User’s responsibility to verify any information that you may obtain on the Website with independent authorities before acting upon it.
It is the User’s responsibility to use suitable anti-virus software on any material downloaded from the Website.
The Company shall have no liability Users for any loss (including loss of profit or other direct or indirect economic loss, indirect or consequential loss) or damage of any nature (howsoever caused) or loss or damage (contractual, tortuous, breach of statutory duty or otherwise) arising from any breach of any express or implied warranty or condition of the Contract or any negligence, breach of statutory or other duty on the part of the Company or its sub contractors or personnel or in any other way out of or in connection with the Contract except for death or personal injury resulting from the Company's negligence or fraudulent misrepresentation.
These conditions and any Contract between the Company and the User shall be governed by and construed and interpreted in accordance with English Law and the parties submit to the jurisdiction of the English Courts.
These Terms & Conditions, including the Privacy Policy, constitute the entire agreement between you and the Company in relation to its subject matter and supersede any and all prior promises, representations, agreements, statements and understandings whatsoever. The failure by the Company to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms & Conditions is found by a court of competent jurisdiction to be unenforceable or invalid, you and the Company nevertheless agree that the court should endeavour to give effect to the intentions reflected in the provision, and the other provisions of the Terms & Conditions shall remain in full force and effect.
The User may print hard copies of any material for your own personal non-commercial use.
All other forms of copying are prohibited.
The words sellmyhouse, sellmyhousewrexham, are the trademarks of Sellmyhouse Ltd. Any reproduction of these trademarks is prohibited.
The Company does not warrant the performance or suitability of any of the Local Property Specialists and it is the Users responsibility to carry out all necessary checks to ascertain the suitability of Local Property Specialists before using their services.
The Company cannot be held liable by the User if a Local Property Specialists does not provide the advertised discount.
The Company is registered to collect information in accordance with the Data Protection Act.
The Company reserves the right to change these Terms and Conditions without prior notice to you. If the Company changes the Terms and Conditions, they will be posted on the Website and become effective at the time of posting.
3.1 The Company offers a Seller, the use of the Website on which for a fixed fee the Seller can advertise the sale of a property .The Company is NOT acting as an Estate Agents but merely provide the tools for Sellers to sell their own property.
3.2 A "For Sale Sign" and "Pay as you go Mobile Phone" are available to the Seller as part of the Listing Fee. These will be delivered to the Seller soon as possible after the Sellers property has been listed on the Website. A £30 refund is offered for the return of signs and mobile phone in excellent condition. Sellers are responsible for payment of all charges in respect of Pay as you go mobile, and topping up of credit.
3.3 The Company will only seek to charge you for a replacement "For Sale" board if a replacement board has to be provided to you at the Sellers request. The Seller is fully responsible for the For Sale Sign and Mobile Phone. The current charge for a replacement board is £29.99 (to include postage and packaging). The provision of replacement boards is at our absolute discretion and the price is subject to change without notice.
3.4 Online viewing of the Sellers property will be via the Website.
3.5 The Listing Fee becomes payable at the time when the listing procedure has been completed and property particulars are ready to upload.
3.6 The Company will advertise a property for sale until sold, or until de-listed by the user. If the Seller decides not to sell and de-list, then the Seller will be entitled to re-list the same property at a future date at no additional cost.
3.7 The Company reserves the right to de-list any property at any time without notifying the Seller.
3.8 It is at the Company’s total discretion in which local media the Website is advertised on.
The Seller accepts that the Company can only do its best to ensure that the Sellers details reach the maximum number of buyers. The Company cannot be held responsible if the following happen:
Sellers will ensure that they comply with all legislation relating to HIP’s and if a HIP is required they confirm as part of the property listing process a HIP has been commissioned.
Properties on the market before certain dates, whether with an Estate Agent or advertises privately are exempt as long as they have been continuously marketed. A break in marketing after these dates, even for 1 day, will then trigger the need to buy a Home Information Pack.
If the Sellers property was on the market BEFORE the following dates, the Seller does not require a HIP:
The Seller fully indemnifies the Company in respect of any costs, charges or fines imposed on the Company as a result of the Sellers failure to provide or commission a HIP.
